
(TruthAndLiberty.com) – A Balm Beach, Florida tax attorney has filed a legal challenge over whether or not former President Donald Trump is eligible to be running for the White House in 2024 under the U.S. Constitution’s 14th Amendment.
On Thursday Lawrence Caplan had filed in a federal court his legal challenge, citing Trump’s involvement in the Jan. 6, 2021 Capitol attack. As he pointed out in his filing there is a clause in the 14th Amendment that specifically blocks those who “have engaged in insurrection or rebellion” from being able to hold office again.
In the filing, he claims that Trump had “both engaged in an insurrection” and had aided others who were involved in it. He added that as per the meaning of the 14th Amendment’s Section three and assuming that all of the public records thus far are correct there is no evidence to suggest the contrary which would mean that Trump is not eligible to be running for the White House or any other office.
While many legal experts have pointed out that this Amendment might apply to Trump, Caplan has been the first question to bring forward a legal challenge that will examine whether or not Trump is actually allowed to participate in the 2024 presidential election. Trump is currently facing both a federal case and a state case over his attempts to overturn the 2020 presidential election results. In the federal case specifically, the role Trump had in the Jan. 6, 2021 Capitol attack is also being examined.
Caplan during an interview with The Hill argued that it was necessary “someone” “to take the lead” and challenge the legality of Trump’s candidacy.
